The objective is to take timely and corrective action for prevention of industrial unrest and disputes. A data bank has been developed on the number of strikes, lockouts, lay-off, retrenchment, closure, workers involved and extent of mandays lost, production loss, etc. The data bank is primarily based on information made available by the Labour Bureau, Shimla.

Ø                  INDUSTRIAL TRIPARTITE COMMITTEES (ITCs)

 

§                                             ITCs have been constituted with the view to promote the spirit of tripartism.  These tripartite bodies provide a forum whereby the social partners through dialogue can appreciate the problems of industries and workers affected by Economic Reforms. These Committees are non-statutory Standing Committees meetings of which are convened as and when required. Government’s proactive role has successfully harmonized the interest of the employers and the workers resulting in a change of attitude from confrontation to that of co-operation.

 

§    There are 8 ITCs, one ITC each on

  1. Cotton Textiles Industry
  2. Jute Industry
  3. Road Transport Industry
  4. Electricity Generation and Distribution Industry
  5. Engineering Industry
  6. Sugar Industry, and
  7. Chemical Industry
  8. Plantation Industry

 

§    In 2003, meetings of the Industrial Tripartite Committees on ‘Road Transport’, ‘Jute Industry’ and ‘Cotton Textiles industry’ were held on 10th April, 25th August, and 15th December, respectively.

 

§    In 2002 and 2005, meetings of the Tripartite Industrial Committee on Plantation Industry were held on 3rd April, 2002 and 26th August, 2005 respectively.

 

 

 


Ø                  CLOSURE, RETRENCHMENT & LAY-OFF

 

§    Under Chapter V-B of the Industrial Disputes Act, 1947, application for permission for closure, retrenchment & lay-off is received from CPSUs for which the Central Government is the appropriate Government and from other establishments which fall in the Central sphere.

 

§    These applications are examined and a hearing is held at the Joint Secretary level in order to provide an opportunity to both the management and the workers to make submissions on the issue. Decision as to granting or not granting permission for closure, retrenchment or lay-off is taken at the level of Hon’ble LM/Secretary (L).

 

§    To the Legal Affairs department website for relevant provisions of the Industrial Disputes Act, 1947, including relevant forms (PA, QA, etc.).
