(iii)     FAILURE OF CONCILIATION REPORTS

 

The FOC reports are processed in the IR Desk for referring them to the Industrial Tribunal or for declining reference.  The administrative Ministries are given a time limit of 60 days to furnish their comments.  The government, as part of its administrative function, is entitled to go into the prima facie merit of the dispute for deciding whether to refer it for adjudication or not.  The Govt. may decline reference if :

 

·                    The claim is very stale, or

 

·                    Opposed to the provisions of the Act, or

 

·                    Inconsistent with any agreement between the parties, or

 

·                    Patently frivolous or the concerned person is not a workmen as defined in the Act.

 

 

Disputes which are raised five years after occurrence of cause of disputes are generally considered to be belated.  The Government may also decline reference if the dispute is likely to have an adverse impact on the general relations between employers and employees resulting in dilution of the managerial prerogatives or discretion.  Therefore, disputes regarding transfer, job locations etc. are generally not referred unless a prima facie case of mala-fide  or violation of agreement exists.  Disputes on matters  which can be resolved by an application under Section 33(c)(2) of the Act relating to recovery of dues are not referred.  On the other hand, disputes raised under Section 2(a) of the I.D. Act in respect of discharging / dismissal / retrenchment / termination of services are normally referred.

 

Details of failure of conciliation reports received and disposed off during the last three years are given in Graph-I.  Yearly disposal of cases including break up of cases referred for adjudication and those declined is given in Graph-II.
